In Virginia it's anything from a
hot- dog stand to a catering business.

The problem is it's too broad--
when it comes to thinking about banning
smoking in restaurants.

The Department of Health has been
meeting with restaurant owners and
anyone else interested this summer to
try and narrow it down.

They've decided to use the term
"food establishment" to describe places
that serve food.

The word "Restaurant" will be
reserved for enclosed places where food
is prepared, served and consumed.

The draft definitions now go to
Governor Kaine who's interested in
finding a way to ban smoking in
restaurants.

it leaves the patient with no movement
