refused to stop state officials from
collecting "abuser fees."

Attorneys representing three
local motorists went to court yesterday
afternoon, hoping to put the brakes on
"abuser fees" statewide.
But Judge James Swanson said he
doesn't have the ability to tell
another judge that that judge can't do
what the legislature is telling him to
do.
While he rejected the motion for
a preliminary injunction, the lawyers
still want the court to declare the
abuser fees unconstitutional.

Virginians currently favor the leading
Democratic presidential candidates in
almost all head-to-head matchups with
leading Republican ones.
SurveyUSA conducted the poll last
week.
Hillary Clinton has the strongest
across-the-board numbers at the moment,
with John Edwards not far behind.

were held today, Clinton would get 50
per cent of the vote to Rudolph
Giuiliani's 44 per cent. Her leads over
Fred Thompson and Mitt Romney are even
greater.
Thompson is the only Republican who

Virginians say they would choose him
over Barack Obama, 47 to 45 per cent.

There's only a slight chance of a stray
afternoon shower across southwestern
Virginia. A cold front forecast to
cross the area Thursday will bring some
changes to the local forecast. Look for
more clouds Thursday and a chance of a
few showers. Unfortunately, "rain"
won't be the primary weather-maker with
this boundary. Most of the wet weather
will stay to the north and west of the
Old Dominion. Once the front passes to
the east, expect rapid clearing for
Friday and the upcoming weekend, with
cooler temperatures. Friday we'll be in
the low 80s, with mid and upper 70s

embattled NFL star Michael Vick. A
grand jury from Surry County has
indicted Vick and three co- defendants
on STATE dogfighting charges.

conspiracy charge and is awaiting
sentencing in December.
He now faces two more felony

But just how did the hot, dry summer
affect this year's local crop?

Roanoke- some trees are filled with
apples.. while others did not produce
much fruit this year.
Early bloomers like Red Delicious
were hit by a cold snap around Easter.
Hot temperatures and lack of rain
took a toll on some other varieties..
so the fruit is smaller this year.
But at Ikenberry's store people
were happy to see a large supply
including Golden Delicious.

Carroll County school bus crash is
facing charges.

VO-NAT 35 year old Brian Shannon Mayes
was seriously hurt when his S-U-V
crossed the center line and hit a bus
carrying special needs students.
It happened around 7:45 in the
morning on Flower Gap road near Cana.
Mayes is still in the hospital
but will be charged with reckless
driving and driving without a valid
license.
There were 9 people on the bus at
the time of the accident, none of them
seriously hurt.

The U-S Supreme Court has agreed
to make a ruling on a case out of
Kentucky that could affect Virginia.

have chosen.
It's unclear why the court
decided to hear the Kentucky case, but
one Virginia lawyer believes it COULD

delayed it until October 17th because
of pending court action.

Otherwise, the first week of autumn is
proving to feel more like summer. Highs
will push toward the upper 80s again
this afternoon with mostly sunny skies.
There's only a slight chance of a stray
afternoon shower across southwestern
Virginia. A cold front forecast to
cross the area Thursday will bring some
changes to the local forecast. Look for
more clouds Thursday and a chance of a
few showers. Unfortunately, "rain"
won't be the primary weather-maker with
this boundary. Most of the wet weather
will stay to the north and west of the
Old Dominion. Once the front passes to
the east, expect rapid clearing for
Friday and the upcoming weekend, with
cooler temperatures. Friday we'll be in
the low 80s, with mid and upper 70s
over the weekend. Thursday is a
transitional day with mid 80s expected.
