The Commonwealth's Attorney says he will re- try the case against Kevin Chase Newman.
The 17- year- old is accused of killing Anthony Scott Whitlock during a drive by shooting in February at Westside trailer court.
Prosecutors told the jury they'd prove Newman was in the car and pulled the trigger.
Defense attorneys, however, argued Newman did not own the vehicle and the windows were tinted.

The jury deliberated for about five hours before the judge declared a mistrial.

Federal investigators have wrapped up their work at the site of a DEADLY Amtrak train crash in Arizona.

F-B-I investigators are now questioning Amtrak and Southern Pacific employees and reviewing Amtrak's personnel records.

The toy maker says it has received ten reports of injuries involving its 1-2-3 High Chairs, including bumps, bruises and one concussion.
The Consumer Product Safety Commission says consumers should inspect the chairs for cracks and contact Playskool for either a free repair kit or replacement chair.
The agency says the company is asking merchants to stop selling the highchair until repair kits can be included with each chair.

White is charged with killing Oliver Everett, Junior during a robbery at the Danville Winn Dixie in June of '94.

Circuit Judge James Ingram denied the request saying the majority of the media coverage happened when the crime occurred more than a year ago.

Police say Warren died about an hour later at a Danville hospital.

A suspended South Carolina high school student killed himself after he alledgely went on a shooting spree in his school yesterday morning.

Police say 16-year-old Toby R. Sin-cino came to school armed with a handgun and shot a teacher in the FACE. Then, he went to a teacher's workroom where ANOTHER teacher collapsed and died.
It was NOT clear if she had been shot, but an initial examination did not reveal any wounds on her body.
Sin-cino then tried to get into the school's office before he shot and killed himself.
The wounded teacher was in serious but stable condition at a local hospital.

It happended yesterday morning on Interstate 75 outside of Lexington, Kentucky.
The tombstone landed on the van in which the girl was riding.
She died later of injuries she suffered when the stone hit the vehicle.

Mr. Clinton will visit Williamsburg for a few hours today to speak to the Business Council ... a group of one-hundred leaders of the nation's largest companies.
The president is scheduled to give a seven-15 p-m speech to the council's annual meeting at the Williamsburg Lodge Conference Center.
