The judge has given attorneys for both sides up to 90 minutes for their closing statements.

A 25- year- old Henry County man was shot and killed in what police believe to be a drug related incident.
Orbin Smith Junior was found shot at his home on Carver Road at about ten last night.
He was taken to Memorial Hospital of Martinsville and Henry County where he later died.
Police are still investigating.

Johnson was shot and killed by her boyfriend one week after he was arrested and charged with stalking her.

(( They came to say good bye.
Alesha Johnson had just recently turned 21.
And police say last Thursday, Johnson was shot by her former boyfriend 26-year old Larry Mack.
Family members say she was moving on with her life. ((ANGELA JOHNSON/ALESHA'S SISTER: JUST BECAUSE A WOMAN DOES NOT WANT TO BE WITH YOU ANY LONGER IS NO REASON TO KILL HER AND TAKE HER LIFE. YOU MOVE ON.))
Family members say Mack had been staking out their apartment for weeks.
And shortly before her death Johnson filed stalking charges against him.
The stalking law went on the books in 1992.
Many say its over used and not taken seriously. ((DARLENE YOUNG/THE TURNING POINT WOMEN'S SHELTER: I THINK WE SHOULD STAND UP AND START ENFORCING THESE LAWS AND STICKING UP FOR THESE WOMEN.))
The law states that a person is guilty of stalking if on more than one occasion that person's behavior places another person in reasonable fear of death, sexual assault or bodily injury.
If convicted it's a class two misdemeanor with a maximum sentence of six months in jail. ((BETTINA ALTIZER/ATTORNEY: IF THAT PERSON IS CONVICTED MORE THAN ONCE IT'S A CLASS ONE MISDEMEANOR AND THAT IS UP TO 12 MONTHS IN JAIL. OR A 25-HUNDRED DOLLAR FINE. Bettina Altizer says maybe using computers to improve communication between the different divisions of the court system will help prevent cases similar to Johnson's.
Alesha Johnson's family says they'll do what ever it takes to help other families avoid losing a loved one.
They says they want Alesha to be more than just a statistic.

He then went to a family member's house and committed suicide.
The Macks say Larry was confused about the break-up with Johnson, who he had dated for two years.

A Virginia Tech student is dead following an accident on Interstate 81 in Montgomery County.

20- year- old Robert Lee Matheson of Danville was killed when another car crossed the median and hit his car in front of the Ironto Rest area.
23-year-old Keith Wallace was the driver of the other vehicle.
He suffered minor injuries.

And a four- year- old boy DIED after an all-terrain vehicle on which he was riding rolled into the path of a pickup truck in Giles County.
State police say Brandon Mulford died Saturday.
Brandon and a teen-ager were riding Thursday on a grassy patch in a trailer park where the younger boy lived, when the older boy fell off the vehicle.
Brandon remained on the vehicle, which then rolled onto Route 4-60 and was struck by the westbound pickup.

Traffic was reduced to one southbound lane on the major road connecting Franklin and Henry counties with Roanoke.
But it was never stopped completely.
The driver was airlifted by helicopter to be treated for his injuries.

During World War Two she was part of the three sister team that cheered Americans through a time of fear and uncertainity.
Maxine Andrews, one of the legendary Andrews' sisters, died of a heart attack this weekend while vacationing in Cape Cod.
She was 79.

As America marched off to the battlefields of Europe, sailed off to the Pacific theater, the Andrews sisters were with them...in spirit and voice.

They might not have been in the military, but they were the military's favorite daughters, singing at war bond rallies across America, visiting soldiers at military posts and hospitals, traveling to North Africa and Europe for the USO.
In public it seemed the Andrews sisters were in uniform more often than not.
MAXENE: TO THIS DAY, I'M SURE THAT THERE ARE PEOPLE WHO EXPECT ME--WHEN I COME OUT AND DO CONCERTS, EXPECT ME TO COME OUT IN THAT UNIFORM."
Together with her sisters Patty, in the middle, and Laverne on the right, who died in 1967, Maxene Andrews had 19 gold records..and sold more than a hundred million copies of their songs. Even today, Andrews sisters recordings still sell more than a million cd's and audio tapes each year.
Maxene was the only one to move on with her singing career after the Andrews sisters stopped recording..yet she still remained tied to world war two.
She wrote a book about the war years recently..and last month, was a guest of honor at vj day ceremonies in Hawaii.
Toward the end of her life...Maxene didn't think much about the Andrews sisters...never played their records..rarely saw her surviving sister Patty.
Not because she wasn't proud of what the andrews sisters did...she says..it was just a period of her life that was done.

Should a deal be completed, it would create a bank with more than 400- billion dollars in assets.

Rick Mast was the leader at this point and just about to pass Jeff Gordon, putting Gordon a lap down.
Mast makes the pass and Gordon gets hit in the rear by Greg Sacks as he tries to go into the pits for a tire change on lap 156.
Michael Waltrip, who started on the outside pole, gets hit by Shane Hall and slides into the barrels at pit row.
Mast has some engine problems and pulls his car behind the wall.
Then Earnhardt loses his chances at winning when he is black-flagged for what appeared to be a missing lug nut.
But when he pitted, the lug nut was there.
To correct the mistake NASCAR pulls out the caution and re-lines the cars putting Earnhardt seventh.
