The State Supreme Court has upheld a 200-thousand dollar damage award
against Norfolk and Western Railway.
It's a contrast to many appeals brought by the railroad.
In this case of Alfred Johnson, the supreme court agreed: the rail car
welder was due some compensation.
He developed "carpal tunnel" syndrome within a year of going to work for
N-W, operating a hand-held grinder.
In a 10-page opinion, the court took the railway to task for "incorrectly
placing a slant on the evidence."
For example N-W said Johnson failed to show that "carpel tunnel" syndrome
was "foreseeable." The phenomenon appeared in medical literature as early as
1981, but it took the railroad until 1994 to warn its workers about it.
