(( It's a huge blow to the historically unified tobacco industry...one of its smallest members...the Liggett group has agreed to settle in a class action suit that charged cigarette makers knew nicotine was addictive. (( JOE CHERNER/PRES. SMOKEFREE EDUCATION SERVICES:FOR THE FIRST TIME IN HISTORY WE HAVE A TOBACCO COMPANY ACKNOWLEDGING THAT MAYBE THEY'RE NOT SELLING HEALTH FOOD.))
Perhaps most significant is the fact that Liggett has broken ranks. The other major companies being sued including RJ Reynolds and Philip Morris have not settled.
So that image of all tobacco executives testifying under oath that nicotine is not addictive would be a different picture now. (( JOE CHERNER: IF YOU LOOK AT THE SEVEN EXECUTIVES TESTIFYING BEFORE CONGRESS...YOU NOW HAVE ONE SAYING THE OPPOSITE...SO THEY'RE NOT THIS MONOLITHIC ENTITY ANYMORE...THERE ARE CRACKS IN THE WALL NOW.)) The class action suit was brought by a consortium of lawyers representing every American smoker who claims to be addicted...those lawyers today held a press conference saying its a start. (( WENDELL GAUTHIER/ATTORNEY FOR THE PLAINTIFFS:)) As part of a widespread agreement Liggett will pay five percent of its pretax earnings over 25 years into funds to help people quit smoking...it has also agreed to end advertising that appeals to children. ((JOE CAMEL IS DEAD)) According to published reports Liggett settled to free itself from the costly tobacco litigation. and while Liggett is the first...it may not be the last. With decades of lawsuits ahead of them...tobacco companies may find that settlements are the cheapest way to stay in business. E.K. CBS News New York.))
