The trial of Scott Overby continues today in Christiansburg.
Overby does not deny he killed his estranged wife, but he says he's not guilty of CAPITAL murder.
(----------------)
VO-NAT
SUPER=@File;

He's already pleaded guilty to defiling Sheila Ann Stafford's body and faces up to five years in prison.
He admits he wrote racial slurs on her body, mutilated her with a knife, and sexually assaulted her with objects such as jewelry and the handle of a plunger.
But his lawyers will argue because those events happened AFTER rather than DURING the murder, it's not a capital offense warranting the death penalty.
They'll ask the jury to consider the lesser charges of first degree murder or manslaughter.

The fight to build Virginia's first parimutuel horse racing track is over --seven and a half years after voters gave the go- ahead to the idea.

The Virginia Jockey Club says it's giving up its plan for a northern Virginia track.
That opens the gate for the Ohio- based developer of Colonial Downs to finish construction.
Colonial Downs is between Richmond and Williamsburg.
Jockey Club officials say they got a fair hearing from the Virginia Court of Appeals last month -- and lost.
They say pursuing their legal battle over how the license to bring this kind of horse racing to Virginia was handed out- would NO LONGER help the state's horse industry.
