Lawyers came to court ready to argue.
No more testimony.
Now it s all about the attorneys from both sides trying to convince the judge whether or not he should conduct two separate trials.
Defense lawyers make a fairly straight forward point: they say the jury will not be able to give Timothy Mcveigh and Terry Nichols the attention each man deserves...that they may be presumed guilty by association.
But that's not all.
Both Mcveigh and Nichols have made statements which will--in effect--become testimony incriminating the other. THAT PUTS ON ME THE BURDEN OF TRYING TO SHOW-AS I SAID IN COURT TODAY--THAT TIM McVEIGH IS A LIAR. MR. JONES IS GONNA TO HAVE TO SHOW--TRY TO SHOW THAT TERRY NICHOLS IS A LIAR.
If they re tried together, neither defense lawyer will be able to challenge those statements through cross examination. That--they say--is against the law.
But prosecutors say, two trials would be too cumbersome, too burdgnsomg on victims and too expensive. they say, nearly all of the evidence applies to both Nichols and McVeigh, that the bombing was a joint operation and this should be a joint trial. Byron Harlan, CBS News, Denver.))
