28 year old Veronica Via is accused of fatally beating her daughter Jasmine last December.
The prosecution is seeking a first degree murder conviction.
But the jury, which has just begun deliberations, has the option of convicting on a lesser charge.

A guard at a state correctional unit in Botetourt County has resigned following his arrest on drug charges.
Police say a search of Richard Quarles' Roanoke County home turned up three ounces of cocaine and a pound of marijuana.
The arrest followed an anonymous tip from a scanner buff who overheard suspicious telephone conversations.
Authorities say Quarles was already under investigation, but the tip helped them secure the search warrant.
Investigators say they have no evidence that Quarles distributed drugs at the Botetourt Correctional Unit.

The Ohio plant that will close has nearly 500 employees.
Some will be offered jobs elsewhere with Volvo- GM.

About 200 people have been laid off there this year.
The move does promise to bring more production to the Dublin site.
