Mark Lilly today refused to testify against his brother Ben, who's on trial
for capital murder in Montgomery County.
Instead, Mark invoked his fifth amendment right against self- incrimination.
The prosecutor then played Mark's taped statement to police, in which he
named his brother as the triggerman in the shooting of Virginia Tech student
Alexander Defillipis.
Testimony in Ben Lilly's trial resumes tomorrow.
Mark Lilly is scheduled to stand trial for his part in the murder next
month.

The couple on tenth street in Roanoke had fought before- -sometimes
violently.
So when Garret Wayne Cunningham and Rhonda Banks Cunningham got into an
argument early this morning, she went and got a gun.
She later told police she first put the gun to her own head out of
frustration. When she lowered the weapon, her 42-year old husband tried to
take it away from her, and it went off as they grappled over it.
He died a few hours later of a gun shot to the head.
She has NOT been charged- -but COULD be- -once test are completed and the
prosecutor reviews the facts.
