Governor George Allen has spared the life of a Virginia Beach killer who was scheduled to die at 9 tonight.
It's the first time Allen has intervened in an execution.
Ten have been carried out under his watch.
The Governor says he gave NO consideration to juror affadavits that they may have wrongly convicted Joseph Patrick Payne in 1986.
Payne faced lethal injection for burning another inmate to death while incarcerated for a prior murder.
The Governor says there's ample evidence of Payne's guilt -- but he commuted Payne's sentence to life in prison.
A spokesman says Allen gave NO reason for sparing Payne's life.

The blaze began in a Warehouse at the Heaven Hill Distillary about 35 miles south of Louisville.
It quickly swept through several buildings sending flames hundreds of feet in the air.
More than 100 firefighters battled the blaze-
But the high wind did not help.
The family owned distillary produces several popular bourbons including Evan Williams and others.
No one was hurt in the blaze- still no word on how it started.

The move came after fifth-grader Jason Gardner had his copy of the "Limbaugh Letter" taken from him in class in September.

Civil liberties attorneys from the Rutherford Institute have threatened to sue the school unless the policy banning outside books was revoked.

Two players taking a part in the Maroons success are New Zealanders, Shane Green and Adam Birch.
The missed opportunity to participate in sports while receiving a solid education in Europe, is what has drawn many athletes like Green and Birch to area schools. ((:)) Adam expresses that the biggest style difference from European play is that of one-on-one play. ((:)) ((:)) ((:))
