It's NOT California or Arizona.
Virginia's had a law allowing the medical use of marijuana on the books for
almost two decades.
GRAPHIC=n7 at five
Good Evening, I'm Jean Jadhon...
The discovery of this obscure, and apparently never used law comes just days
before the 1997 General Assembly convenes.
Connie Stevens has followed the medical marijuana controversy from
California to Washington.
Who'd have thought Richmond would be so far ahead of the curve?
Jean, this law was actually passed in Virginia's General Assembly in 1979.
The chief sponsor was then-state-senator Rick Boucher...who's now of course
a southwest Virginia Congressman.
The Richmond Times-Dispatch newspaper uncovered the law over the weekend.
And we've yet to find anyone who should have known it existed who will admit

Ellen Qualls is in our Richmond newsroom with some of the political
machinations that are resulting.
Connie, let me clarify Congressman Boucher's position first.
We spoke with him by phone.
He wants to make it clear that this provision was part of a much larger
legislative package reforming drug laws.
He does NOT remember this part of the bill.
But he defends it as being so narrowly drawn that marijuana would only be
available through a doctor's prescription, in CAPSULE form.
And we haven't found any Virginia pharmacies that are legally allowed to do
so or have.
IN Q=That's NOT

That's NOT to say some politicians won't try to make some political hay out
of trying to repeal it, as Boucher's 1979 co-sponsor points out.

Immediately stepping up to the plate is a man who wants to avoid a liberal
label the year he runs for governor.
((LT. GOV. DON BEYER: WE DON'T WANT TO DO ANYTHING THAT BLESSES THE USE OF
THESE KINDS OF CONTROLLED SUBSTANCES. WE'RE FIGHTING WITH OUR KIDS EVERYWHERE
TO MAKE SURE THAT THEY DON'T EXPERIMENT WITH MARIJUANA IN HIGH SCHOOL OR

TO LEGITIMIZE ITS USE.))
But from the House conservative leader, a different view.
((DEL. VANCE WILKINS/R-AMHERST: IF WE CAN CONTROL ALL THESE OTHER DRUGS, THAN
WE SHOULD BE ABLE TO CONTROL THE SMALL AMOUNTS OF MARIJUANA THAT MAY BE
NECESSARY TO TREAT THESE PARTICULAR DISEASES.))
So apparently there an endorsement of the medicinal benefits of marijuana
