Mark Lilly's statement to police helped convict his brother of capital
Today, Lilly recanted those words, as a judge prepared
to sentence Ben Lilly to death for the murder of a Virginia Tech student.

What Mark Lilly DID tell authorities was that his brother Ben killed
Alexander DeFilippis after they, and a third man abducted the Tech student.
But as Judge Ray Grubbs considered whether to impose the jury's recommended
death sentence, Mark called his earlier statement a lie, and said he's not sure

The case doesn't end here. A death penalty ruling is subject to an automatic

any actual date with death may still be years away. Tracy Altizer, News 7
It was the same story in Amherst County, where convicted killer James Burley
says he took the fall for two murders in order to protect a close friend.
Burley's surprise testimony came during his sentencing hearing this
afternoon in Amherst County circuit court.
He'd been convicted of murdering Robin Burge and Jacqueline Carter in
separate incidents in the winter of 1995.
On the stand today, Burley admitted he helped hide Carter's body, but
claimed it was his friend.. Sammy Lee Brown.. who killed both women.
Burley spent a year in jail before coming forward with this information, but
he left court today sticking to his story.

The panel convicted Brown of first degree murder for the shooting death of

Brown and Crews had gotten into a shouting match after leaving the Pepper
Baux (box) restaurant that night.
Brown fired several shots into the air, then shot Crews once in the chest.
Defense attorneys had argued Brown was in fear for his life.
