A federal judge in North Carolina has dealt a mixed ruling on
the government's effort to regulate tobacco sales to minors and tobacco
Predictably, both sides are claiming victory.

In the heart of tobacco country.. a ruling that is considered a partial
victory for both sides in the tobacco debate.
The bottom line of this 65 page
decision: U-S District Judge William Osteen ruled that the Food and Drug
Administration has the right to regulate tobacco as a drug.
The ruling also gives the F-D-A the power to control cigarette labelling.
and.. Osteen says that the F-D-A can impose restrictions on access to
cigarettes.. a ruling that
in effect supports a ban on vending machines in many public places.

Osteen's ruling, though, means that Joe Camel and the Marlboro Man are in
no danger of dying off anytime soon.
He ruled that the F-D-A does not have the authority to regulate
advertising and promotion of tobacco products.

The battle is now unfolding on two fronts: the big four are currently in
negotiations to set up a 300 billion dollar fund that will protect them from
future lawsuits in exchange for submitting to some f-d-a regulation. and.. the
Liggett Group is expected to release powerful documents that supposedly prove
that the tobacco industry has known for decades that smoking is addictive.

And so.. the battle may be heating up but we have a long way to go before a

Capital murder suspect Miguel Ortiz made his first appearance in court
He was arraigned on six charges associated with a double murder April 1st
at Carew Apartments.
He allegedly shot and killed Sharon and Deborah Casey before police subdued
him with gunfire.
Ortiz is being held withOUT bond.

Two men have agreed to testify against an alleged killer, in exchange for
Darick Wetzel of Pulaski County pled guilty as an accessory to the murder
of Elmer Eugene Fisher.
The state plans to ask for a 30 year sentence.
Fisher's body was found stabbed in the New River.
Last week Eddie Gibson of Richmond pled no contest.
Gibson and Wetzel are expected to testify against Joseph Graham Junior.
Convicted killer Jens Soering continues to wage his battle for a new trial,
saying two drifters could have murdered his girlfriends parents.
But some of the jurors from Soering's 1990 trial say they're skeptical of
Soering claims two drifters who were arrested in Roanoke for a 1985 murder
could have murdered Derek and Nancy Haysom a few days earlier.
That theory was never introduced to jurors in the 1990 trial.

Earlier this week, Judge William Sweeney denied Soering's request for a new

Friends and family are rallying around a teenage girl who saw her mother and
sister shot to death three weeks ago.
Vanessa Dalton's father, Donnie Ray Dalton, opened fire on his wife through
the window of the family's trailer before taking his own life.
Audrey Dalton died at the scene.
16 year- old Andrea Dalton died during surgery.
Family members say 15 year- old Vanessa is living with an aunt and uncle
now, and has returned to school.
They're setting up a trust fund for her.

The wreckage of the warplane was discovered last weekend..
One of two men sought for questioning in connection with the deaths of two
Baskin Robbins employees in Clarkesville, Tennessee has turned himself in.
Authorities are still looking for one other suspect in the deaths of
16-year-old Michelle Mace and 21-year-old Angela Holmes.

ice cream shop where they worked.
Their bodies were found the next day in a state natural area, two miles

The Roanoke Valley S-P-C-A is looking for a new executive director.
Al Alexander announced he's resigning, effective today, for "personal

employees accused him of sexual harassment.
The S-P-C-A board's president wouldn't say whether the allegations were

Van Balen says a shelter employee will fill in as a temporary director--
and the shelter will maintain its normal operations.
The Pittsylvania County N-Double-A-C-P is trying to distance itself from
Governor Allen's decision to cancel a speaking engagement.
The leader of the local N- Double-A-C-P says his organization had nothing
to do with a series of telephone threats.
The Governor was supposed to speak at a tobacco function Monday at Woodlawn
Academy in Chatham.
But he canceled the trip after the school's headmaster received a phone call
threatening the school and its children.
The caller was apparently offended when Allen recently proclaimed April
"Confederate History and Heritage Month".

Older people should take extra caution getting out of bed in the morning.
It's the time of day that elderly people are likely to be thrown off
A study published in the Journal of the American Medical Association says
the problem, known as Orthostatic Hypotension, usually occurs before breakfast.
It's so common doctors may need to avoid prescribing medications that
could make the problem worse.
Virginia has become the first state in the nation to dedicate land to the
cause of organ donation.
Governor George Allen today dedicated the Donor Memorial Garden in Capitol
Square, just down the hill from the state capitol.

Normally a chess instructor would teach his pupil that the rook could move
