A federal judge in North Carolina has dealt a mixed ruling on the government's effort to regulate tobacco sales to minors and tobacco advertising.
Predictably, both sides are claiming victory.

In the heart of tobacco country.. a ruling that is considered a partial victory for both sides in the tobacco debate.
The bottom line of this 65 page decision: U-S District Judge William Osteen ruled that the Food and Drug Administration has the right to regulate tobacco as a drug.
The ruling also gives the F-D-A the power to control cigarette labelling. and.. Osteen says that the F-D-A can impose restrictions on access to cigarettes.. a ruling that in effect supports a ban on vending machines in many public places. PRESIDENT BILL CLINTON: FOR YOUNG PEOPLE ACCESS EQUALS ADDICTION. SO THIS RULING IS A MAJOR VICTORY. SEN. FRANK LAUTENBERG, D-NJ STOP PRETENDING JOE CAMEL IS A HERO. JOE CAMEL IS A BUM AND JOE CAMEL SHOULD GO OUT IN A COFFIN!
Osteen's ruling, though, means that Joe Camel and the Marlboro Man are in no danger of dying off anytime soon.

The battle is now unfolding on two fronts: the big four are currently in negotiations to set up a 300 billion dollar fund that will protect them from future lawsuits in exchange for submitting to some f-d-a regulation. and.. the Liggett Group is expected to release powerful documents that supposedly prove that the tobacco industry has known for decades that smoking is addictive. REP. HENRY WAXMAN, D-CA: THEY OUGHT TO BE HELD ACCOUNTABLE, THEY OUGHT TO BE HELD RESPONSIBLE FOR THEIR ACTIONS.
And so.. the battle may be heating up but we have a long way to go before a clear winner emerges.

Two men have agreed to testify against an alleged killer, in exchange for lighter sentences.
Darick Wetzel of Pulaski County pled guilty as an accessory to the murder of Elmer Eugene Fisher.
The state plans to ask for a 30 year sentence.
Fisher's body was found stabbed in the New River.
Last week Eddie Gibson of Richmond pled no contest.
Gibson and Wetzel are expected to testify against Joseph Graham Junior.
