A federal judge in North Carolina has dealt a mixed ruling on

advertising.
Predictably, both sides are claiming victory.

In the heart of tobacco country.. a ruling that is considered a partial
victory for both sides in the tobacco debate.
The bottom line of this 65 page
decision: U-S District Judge William Osteen ruled that the Food and Drug
Administration has the right to regulate tobacco as a drug.
The ruling also gives the F-D-A the power to control cigarette labelling.
and.. Osteen says that the F-D-A can impose restrictions on access to
cigarettes.. a ruling that
in effect supports a ban on vending machines in many public places.
PRESIDENT BILL CLINTON: FOR YOUNG PEOPLE ACCESS EQUALS ADDICTION. SO THIS
RULING IS A MAJOR VICTORY.
SEN. FRANK LAUTENBERG, D-NJ
STOP PRETENDING JOE CAMEL IS A HERO. JOE CAMEL IS A BUM AND JOE CAMEL SHOULD
GO OUT IN A COFFIN!
Osteen's ruling, though, means that Joe Camel and the Marlboro Man are in
no danger of dying off anytime soon.
He ruled that the F-D-A does not have the authority to regulate
advertising and promotion of tobacco products.
CHARLES BLIXT/RJ REYNOLDS
WE ARE VERY PLEASED THAT THE COURT STRUCK DOWN RESTRICTIONS ON CIGARETTE
ADVERTISING AND PROMOTION.
The battle is now unfolding on two fronts: the big four are currently in
negotiations to set up a 300 billion dollar fund that will protect them from
future lawsuits in exchange for submitting to some f-d-a regulation. and.. the
Liggett Group is expected to release powerful documents that supposedly prove
that the tobacco industry has known for decades that smoking is addictive.
REP. HENRY WAXMAN, D-CA: THEY OUGHT TO BE HELD ACCOUNTABLE, THEY OUGHT TO BE
HELD RESPONSIBLE FOR THEIR ACTIONS.
And so.. the battle may be heating up but we have a long way to go before a
clear winner emerges.
