The court refused to hear an appeal from the state and the ACLU.
So a lower court ruling stands.
That court said the district is UNconstitutional because race was the
predominant factor in determining the lines.
The third district runs from Richmond to Tidewater.
The decision means Virginia's only black congressman, Bobby Scott, will have
to run in a new district -- and Virginia lawmakers will have to start arguing

She just had an appendectomy, so benefits stopped again when she had to
take leave from a part-time, minimum-wage job in a day-care nursery.
She does get child support and relies on produce from the garden for food
on occasion. But it's tough, making ends meet.

Central Virginia authorities took to the skies this week in their annual
war on marijuana growers.
State police and National Guard helicopters assisted in aerial searches of
