Opponents had argued that the government had failed to consider all of the environmental impacts of the highway, with its rows of snow making towers, and need for thousands of gallons of water.
In his opinion, Judge Jackson Kiser said that it's possible that the costs may outweigh the benefits.
But he said that "it's not for him to decide the wisdom of Congressional allocations."
The formal groundbreaking for the smart highway is set for next week.

Planned Parenthood officials say they'll obey Virginia's new parental notification law, even though they believe it's unconstitutional.
The law, which requires minors to notify their parents before having an abortion, was blocked by Judge James Turk yesterday afternoon.
But last night, a federal appeals judge overruled Turk, allowing the law to take effect at midnight.
Planned Parenthood appealed the ruling this morning, and a three judge panel will be appointed to consider the case.
In the meantime, a Roanoke Planned Parenthood spokesman says they're meeting with the Commonwealth's attorney to make sure they comply with the law.
