A federal judge has granted death row inmate Tommy David Strickler a new trial.

47-year old Richard Maulick moved to Cloverdale last month...he's living near an elementary school, daycare center and middle school.
He just got out of state prison after serving 12 years for sodomy and aggravated sexual battery.
Maulick says the accusation stemmed from a messy break up with his first wife and even though he pled guilty he maintains he's innocent.

Tyree then allegedly stole a box of costume jewelry which authorities have recovered.
