It's the same case he's accused of botching the first time.

Charges against Cory Kast were dropped over the summer after Spangler failed to prosecute the case in a timely fashion.

He recently obtained direct indictments against Kast on five NEW charges-- including robbery and abduction.
The alleged victim is cautiously optimistic.

A suspect is being held without bond in the beating and robbery of two elderly brothers Monday night.

Seventy-eight- year- old Lucian Mantiply and his 95- year- old brother Cyrus were attacked in their Madison Heights home.
Acting on phone tips, police arrested 25- year- old Joseph Daniel Tyree, a construction worker who lives less than a quarter mile from the Mantiply home.
Police say they found some of the stolen items in Tyree's house.

Virginia Tech President Paul Torgersen has written an open letter to the university community denouncing a racially offensive E-mail message.
The E-mail was circulated by a fraternity student to other members of the fraternity.
A black fraternity member who got the message complained to professors, and eventually about 100 black students saw the posting.
Torgersen's letter asked for a commitment to a diverse campus community.
