Smallwood had to leave the scene of the crime to take his own daughter to her first day in first grade.
What he saw that day prompted him to take a leave of absence.
The prosecutor says this was all the work of Earl Bramblett a friend of the family- -who practically lived at the Hodges' home.
At the time, he was working at the Brewco Sign Company. Police searched the dumspter behind the sign shop and found a picture of Winter Hodges, the 11-year old victim in this case, a T-shirt of hers and some drawings that may depict the Hodges' demise.
Defense attorney Mac Doubles reminded the jury that "just because the government says it's so, does not make it so."))

A central element in the Commonwealth's circumstantial case against Bramblett has to do with ballistics:
Bullets taken from the bodies, shell casings and one live round found in the house all share the same chemical composition as the .22 caliber cartridges found in Bramblett's possession shortly after the fire.
The trial is expected to take two or three weeks.

25 year old David Pryor fled from police, who tried to arrest him for shoplifting at Belk's on August 28.
When Officer Dewey Hancock cornered him behind a nearby furniture store, Pryor sprayed Hancock in the face with the officer's mace and reached for his police gun.
That's when Hancock fatally shot Pryor in the chest.
Commonwealth's Attorney Don Caldwell says Hancock believed his life was in danger, and acted reasonably.
Pryor had been arrested earlier for credit card theft, plus he has a criminal record in New York.
But Caldwell says a Belk store surveillance video shows another side.

Caldwell took over to make sure the investigation was impartial, and he says racism is not the case here.
