A Roanoke County jury sent Frank Pennington to jail in 1995 for killing Bonnie Sue Mullens

Pennington was serving a 42- year sentence in a federal prison.
But his lawyer won an appeal after one of the original jurors had second thoughts about Pennington's guilt.
Jury selection is now underway in his retrial.
Pennington's lawyer spent the day asking potential jurors if they had followed the original case.

A Giles County prosecutor's attempt to revive a botched rape case hit a road block today.

The case involves Corey Kast-- the man indicted in October on several charges including breaking and entering, robbery and abduction of Renee Trump.

At one time, Kast was also charged with raping the woman but was freed from prosecution after commonwealth's attorney Garland Spangler missed the speedy trial deadline.
Today circuit judge Colin Gibb dismissed ALL but ONE of the new charges.

Kast's attorney successfully argued that the October indictment should be dismissed because it was sought after his client was quote "forever discharged from prosecution" when the rape charge was thrown out.
The judge will decide early next week whether he'll dismiss the remaining robbery charge.

Floyd County commonwealth's attorney Gino Williams was named special prosecutor at Spangler's request.
