Pennington was convicted in April of 1995 of murdering Bonnie Sue Mullins and was sentenced to 42 years in jail.
But Defense lawyers later found evidence they said proved Pennington's innocence and the first trial was thrown out.
The prosecutors plan to try the case again.

A man trying to speed away from police is dead after a high speed chase through two states ends in Danville.

Police in Casswell County North Carolina chased the car driven by Gary Arthur James of Danville into Virginia after he failed to stop for a license checkpoint.
James apparently lost control of the car on Holland Road in Danville- hit a tree and the car flipped.
He was pronounced dead at the scene.
Police say they called off the chase before the accident happened.

So the families filed a civil suit against Cornwell last year.
Now they've persuaded 15 lawmakers from both parties to sponsor a resolution that would study how to better protect autopsy records from unauthorized public disclosure.
So what about the Governor -- whose biggest individual contributor's reputation could be on the line with a bill that specifically mentions the "tragic" impact of "crime novels?"

Bisbee says he's been told two pharmaceutical companies: Mylan and Watson, have bought up ALL the raw ingredients for certain nerve drugs.

Rescuers aren't sure how he managed to survive.
They found him yesterday.

This morning's environmental report comes from Alleghaney County where volunteers are banding together to transform the old Kim-Stan landfill.

The place shut down seven years ago but plastic still litters the old dump.
But not for long.
Volunteers want to plant new vegetation on top of the trash, and local companies are donating the mulch and seed.
The trees with red marks will be cut and tied to the slope -- to stop more soil from sliding down the banks.
And then, there's the smell.

The General Assembly has set aside almost half a million dollars to build a ditch around the landfill.
That will carry water around the trashpile, rather than through it, on its way into the river.
Local volunteers hope one day, instead of endangering wildlife, this old landfill could be a park to protect wild animals.

A man trying to speed away from police is dead after a high speed chase through two states ends in Danville.

Police in Casswell County North Carolina chased the car driven by Gary Arthur James of Danville into Virginia after he failed to stop for a license checkpoint.
James apparently lost control of the car on Holland Road in Danville- hit a tree and the car flipped.
He was pronounced dead at the scene.
Police say they called off the chase before the accident happened.

Pennington was convicted in April of 1995 of murdering Bonnie Sue Mullins and was sentenced to 42 years in jail.
But Defense lawyers later found evidence they said proved Pennington's innocence and the first trial was thrown out.
The prosecutors plan to try the case again.
