But lawyers for the state have asked the Fourth U-S Circuit Court of Appeals to allow the execution to proceed.
An attorney for the 29-year-old Buchanan filed a lawsuit last week challenging the authority of Governor Gilmore to review Buchanan's clemency request since Gilmore was the attorney general who fought Buchanan's appeals.
Buchanan is sentenced to die for the shooting and stabbing deaths of four family members in Amherst County a decade ago.

25-year old Thomas Brooks Jenkins was arrested last week after meeting with an undercover Bedford County investigator.

Posing as a pedophile, the officer had been communicating with Jenkins on the Internet for several weeks.
Jenkins allegedly sent the investigator dozens of pornographic images involving children.
Police also seized a computer, diskettes and sexual paraphernalia from his home.
Jenkins was released on a 25-thousand dollar bond.

A Roanoke man faces attempted capital murder charges stemming from a standoff last week in Salem that injured a female police officer.

38-year old Kelvin Vaughn was also injured in the shootout and released from the hospital yesterday.
Police say Vaughn fired shots at officers who were responding to a domestic dispute at his ex-girlfriend's apartment.
Flying shrapnel injured Officer Marge Dillon.
Officer Blake Critz then shot Vaughn twice in the stomach.
Judge Vincent Lilley appointed a Salem lawyer to defend Vaughn and scheduled a court hearing for April 14th.
Police say they also intend to charge Vaughn with killing his three-year-old son as soon as they collect more evidence.

A wrestling coach convicted of assaulting his wife has dropped his appeal, quit his job at Patrick Henry High School and begun serving a 90-day jail sentence.
Elmer Goff Junior was convicted last month in Roanoke but appealed the verdict.
His trial was scheduled for yesterday but was called off and he started serving his jail term.
Goff was charged with misdemeanor assault last September after police were called to his home in southwest Roanoke and found his wife, Lynda, with extensive bruises to her face and neck.
Lynda Goff told police her husband had punched her in the face, choked her and held her against a wall during an argument.

The cars were carrying lumber, paper products and animal feed.
