but they intend to take their client's case to a jury.

The charge was elevated from first degree to capital after Louis Ceparano agreed to testify against Cressell.

Jeff Dorsey and Mark Claytor will continue to represent Cressell as court appointed attorneys.

The second man charged in the capital murder of Garnett "G-P" Johnson will face trial in late August.

Emmett Cressell, Junior was originally charged with first degree murder for allegedly burning and beheading the former black marine.
But last week that charge was elevated to capital murder after Louis Ceparano entered a plea that guaranteed him life in prison over a possible death sentence.
In exchange-- Ceparano agreed to testify for the prosecution.
Before Cressell's August murder trial he be tried in July for allegedly robbing Johnson.

Some are not convinced the plan for Norfolk Southern and CSX to carve up Conrail would guarantee more competition in the industry.
When Norfolk Southern's C-E-O Dave Goode took the stand, he faced some tough questions about how Norfolk Southern would make sure the merger was safe.
