Some are not convinced the plan for Norfolk Southern and CSX to carve up Conrail would guarantee more competition in the industry.
When Norfolk Southern's C-E-O Dave Goode took the stand, he faced some tough questions about how Norfolk Southern would make sure the merger was safe.

Emmett Cressell, Junior was originally charged with first degree murder for allegedly burning and beheading the former black marine.
But last week that charge was elevated to capital murder after Louis Ceparano entered a plea that guaranteed him life in prison over a possible death sentence.
In exchange-- Ceparano agreed to testify for the prosecution.
Cressell will be tried in July for allegedly robbing Johnson.
His capital murder case is scheduled for late August.

Track: Little is left of what was the Munich to Hamburg express.
The train--travelling at 125 miles an hour-- apparantly hit a
bridge support, collapsing the overpass onto the train.
An eyewitness reported a car had been stalled on the tracks:
VOICE OF Andrew Davidson: Eyewitness: And then, out of nowhere,
came the express train, and I mean everybody just closed their
eyes in disbelief. There was just an almighty great crash.
On-Cam: This is Germany's fastest, most expensive and most luxurious train,
catering primarily to businessmen. And, ironically, considered the
safest...that is, until today.
Track: The train jack-knifed, rail cars crashed into eachother,
and were thrown from the tracks.

She said, suddenly there was a loud explosion, like an
earthquake.
More than 800 rescue workers, medical and military personnel joined forces at
the site.
And even those accustomed to rescue operations were stunned by the
carnage

for me.
Track: The dead were laid out beside the tracks as the wounded
were treated at the scene. Those most seriously injured were
helicoptered out to area hospitals. The accessible parts of
the damaged train were searched for any signs of life within.
Tonight, rescue workers, are afraid of what they will
find at the bottom of the rubble. There are reports that a
conductor who was on the train told authorities that the last
two cars contained groups of school children. Rescue workers
are now waiting for a bigger crane to lift what remains of the
bridge from those final cars.))

Norfolk Southern C-E-O Dave Goode said the railroad has developed an elaborate safety plan to ensure the safety of the merger.
