(( AN APPEALS COURT RULING MEANS THREE SECRET SERVICE EMPLOYEES MUST TELL A GRAND JURY IN THE MONICA LEWINSKY INVESTIGATION WHAT THEY OBSERVED WHILE GUARDING THE PRESIDENT. THE THREE JUDGE PANEL REJECTED THE CLINTON ADMINISTRATION'S ARGUMENTS TO CREATE SPECIAL LEGAL STATUS FOR PRESIDENTIAL BODYGUARDS THAT WOULD KEEP THEM FROM GIVING EVIDENCE IN THE WHITE HOUSE SEX SCANDAL INVESTIGATION.
IN ITS DECISION THE COURT SAID-"WE LEAVE TO CONGRESS THE QUESTION OF WHETHER A PROTECTIVE FUNCTION IS APPROPRIATE IN ORDER TO ENSURE THE SAFETY OF THE PRESIDENT."
MEANWHILE... AS LINDA TRIPP TESTIFIED BEFORE KEN STARR'S FEDERAL GRAND JURY FOR A THIRD DAY-THE MARYLAND STATE prosecutor INTIATED A GRAND JURY PROBE OF HIS OWN. STEPHEN MONTANARELLI WANTS TO KNOW IF TRIPP KNEW SHE WAS BREAKING STATE LAW WHEN SHE SECRETLY TAPED TELEPHONE CONVERSATIONS WITH LEWINSKY. ...A TALL ORDER AS MONTANARELLI EXPLAINED IN FEBRUARY.
FROM FEB 11 1998/ STEPHEN ,MONTANARELLI/MD. STATE PROSECUTOR: we have to prove the taper knew the law
TRIPP LIVES IN MARYLAND AND THAT'S WHERE SHE RECORDED 20 HOURS OF PHONE CALLS WITH LEWINSKY-CALLS IN WHICH THE FORMER WHITE HOUSE INTERN reportedly CONFIDED AN ALLEGED SEXUAL RELATIONSHIP WITH PRESIDENT CLINTON. TRIPP THROUGH HER ATTORNEY REACTED TO THE DECISION.
ANTHONY ZACCAGNINI/TRIPP ATTORNEY: they timed it to do this as i was in front of the grand jury.
TRIPP'S ATTORNEYS CLAIM THE PENTAGON EMPLOYEE DIDN'T REALIZE
MARYLAND LAW BARRED SECRETLY TAPE-RECORDED PHONE CALLS. IT WAS NEW YORK BOOK AGENT LUCIANNE GOLDBERG WHO SUGGESTED TRIPP RECORD THE CALLS WITH LEWINSKY...AND ADVISED HER IT WAS OK TO TAPE IN MARYLAND, BUT ADDED HER ADVISORS WERE THINKING FEDERAL RATHER THAN STATE LAW..
THE STATE PROBE WILL TECHNICALLY HAVE LITTLE OR NO EFFECT ON THE FEDERAL CASE. BUT IF TRIPP IS FOUND GUILTY OF BREAKING THIS LAW IT IS YET ANOTHER BLACK EYE FOR KEN STARR.
