The man convicted of killing an Ethiopian immigrant nine years ago in Fairfax County faces execution tonight.
Dwayne Allen Wright would be the first person in 74 years to be executed in Virginia for crimes committed as a minor.
He would also be the tenth inmate executed this year, a new modern Virginia record.
Wright's lawyers filed an appeal with the U-S Supreme Court yesterday, saying he suffered brain damage as a child.
Several jurors recently said they would not have recommended a death sentence if they new about the brain damage.

Last night, the team took up residence inside Tanglewood Mall as fans of the squad gathered to meet the members of this year's team.
First year Express head coach Scott Gordon announced the 21 man roster that he hopes will lead the team to its sixth straight winning season.
Last year the Express won the Northern division championship.

Now if your wondering how this boat ended up in the middle of this causeway, it' didn't fall off a trailer.
It's owner says he lost control of his boat and then hit the causeway at high speed.
It jumped over the rock seawall and ended up in the path of oncoming cars.
The boat owner, the guy in the swimsuit, bailed out just before it hit the causeway and drivers on the road managed to avoid the flying boat.
