Ronald Lee Fitzgerald told his attornies he doesn't want to ask Governor Gilmore for clemency.
The 29-year old has said in interviews that he wants to be put to death because he knows the killings were wrong.
The U-S Supreme Court turned down his final appeal two days ago.
If Fitzgerald is put to death, it will be Virginia's eleventh execution this year.

Cochrane plans to file a seven million dollar lawsuit against the police department on behalf of Robbie Ellison.
But state law limits the amount of punitive damages a person can collect to 50-thousand dollars.

It took place as scavengers tried to scoop up gasoline pouring from holes in the pipeline.

Nato's supreme commander -- U.S. General Wesley Clark -- has been angaged in shuttle diplomacy between Belgrade and Brussels, trying to convince the Serbs to actually comply with the deal they've agreed to.

Both sides accuse the other of starting it, but there is still sporadic fighting going on between the Kosovo Liberation Army -- the guerilla group committed to independence for the Albanian majority province -- and the Yugoslav security forces.
When they aren't shooting at each other, the security forces and the KLA have been keeping a close watch in each other's positions.
While international monitors on the ground -- helped by spotter planes in the air -- have been trying to confirm that the Serbs have been pulling back their forces to comply with the peace deal. So far they haven't seen enough of a pullout to satisfy them.

The Houston Chronicle says 17-year-old Dominique Moceanu (moh-chee-AH'-noo) ran away from home Sunday, and filed the lawsuit the next day.
She claims her parents squandered her fortune and oppressed her for years.

Police say a tractor trailer struck a car, then hit a cement column on a bridge.
The driver of the car was thrown from the vehicle.

The accident is still under investigation.
