He has until nine to decide. That's when Carl Chichester is scheduled to die by lethal injection.

Clyde Bryant has promised he'll own up to money laundering and wire fraud.
The 54-year old arts and antiques dealer signed a plea agreement last week, pledging to enter guilty pleas next month. The bargain says Bryant may be responsible for swindling his wealthy clients out of as much as five million dollars... money he squandered on the gaming tables in Atlantic City.
The government will ask for a five-year sentence and restitution of 2-and-a-half million dollars.
