A Lynchburg jury is facing a life or death decision in the capital murder trial of Darrell Lamont Fleming.

The 33-year-old Fleming was convicted yesterday of capital murder and robbery for the stabbing death of 16-year-old Cory Pennix last August.
Fleming killed Pennix and then stole drugs and money from his body. The seven man five woman jury sentenced Fleming to 25 years for the robbery. They're now hearing evidence on whether Fleming should get life in prison or the death penalty for the murder.

Virginia could end the fiscal year with a more than 200 million dollar budget surplus.
State economic officials say tax collections have pushed revenue estimates above the Gilmore administration's revenue forecasts.
The administration's top financial officer says the state will likely enjoy a surplus when the fiscal year ends June 30th.
Strong job growth, wage gains, low inflation and interest rates and a strong stock market have fueled strong revenue collections.

The rape case against former Tech football star Jim Druckenmiller has been continued following arguments over evidence at yesterday's preliminary hearing.

Druckenmiller, who now plays for the San Francisco 49-ers, is accused of raping a Tech student at a party in Blacksburg, back in March.
He admits he had sex with the girl but says it was consensual.
Yesterday, Druckenmiller's attorneys asked the court for access to more of the prosecution's evidence.
They claim prosecutors are withholding certain witness statements that could help prove the young woman was the aggressor that night.

A convicted murderer from Halifax County is getting out of prison because of a clerical error.

Louis (LEWIS) Jordan Powell Junior's 28-year murder sentence was overturned yesterday by the Virginia Court of Appeals.
The court threw out the sentence because Powell was not tried within five months of his preliminary hearing.
The Halifax County Commonwealth's Attorney said of the court's decision:
"In this instance they celebrate form over justice. I think this decision does a disservice to the pursuit of justice in Halifax County."
Powell still has to serve several months in prison on weapons charges.

Teresa Duggan was sentenced yesterday.
She had her own business in Massachusetts, recruiting physicians.
She claims she had 12 years experience placing professionals, but Duggan told the judge that she was "overwhelmed by the magnitude" of Carlion's needs.
Duggan and a Carilion's staff recruiter conspired to steal more than 300-thousand dollars from Carilion.
Duggan has begun paying back her share of the money.
