Despite new evidence that a key witness may have lied, a federal judge says he has NO jurisdiction to hear Tommy David Strickler's latest appeal.
That leaves Strickler six days before his scheduled execution to try to present the evidence to the federal appeals court, the U-S Supreme Court, or the Governor.

Tudor's husband turned over the letter to Strickler's attorney last fall.
In it, she allegedly says Strickler didn't kill JMU student Leann Whitlock, that Tudor lied at trial, and that Strickler actually tried to help the girl.
Today, his attorney tried to file two NEW secret affadavits from others, saying Tudor told them she had lied on the stand too.

(( But federal Judge Robert Payne concluded that he doesn't have jurisdiction... But he noted the new evidence Tudor may have lied, AND that the U-S Supreme Court has concluded that an alleged witness at the mall where Whitlock was abducted may have been confused or lied also.
He bases the ruling on the 1996 Anti-Terrorism and Effective Death Penalty Act, that will keep Strickler from a second round of federal appeals, unless a higher court agrees to hear them.
That means NO court has heard evidence the Tudor may have lied.

The implication of all this is that Strickler's co-defendant, Ronald Lee Henderson, may have actually killed Whitlock.
He fled and was tried a year after Strickler was given the death penalty.
Henderson got three life sentences.
Augusta County prosecutor Lee Ervin says there's NO way either man could have acted alone-- because a 69-pound rock was used to crush Whitlock's head.

Now the case of a woman who fired several rounds from a .22 rifle before calling 9-1-1 hoping to reach the suicide hot line.
It was April 27, 1996... Christiansburg police shot Stella Arcaro, when she came out of the house carrying the loaded rifle, refusing to put it down.
Arcaro filed suit.
But a federal judge ruled police acted reasonably, so he dismissed the claim.

A jury found Calvin Lamont Pinchback not guilty of murder in the shooting death of Delvecchio (Del-VECK-eee-o) Farmer.

A former Danville police officer has found guilty of contributing to the delinquency of a minor.

25-year-old Dewey Joseph Hancock was off-duty when he attended a party where a 16-year-old girl was drinking last December.
Hancock said he didn't know the girl was drinking alcohol.
But the judge said he had a special responsibility as a police officer to make sure she didn't.
Hancock was fined 250-dollars and got a suspended 10-day jail sentence.

Stanley Furniture is disputing charges that it violated air pollution laws by failing to fix a broken boiler.

The Environmental Protection Agency has filed a complaint charging that the furniture company broke the Clean Air Act for nearly five years by running the boiler.
Stanley Furniture responded today that the boiler failed a one-time E-P-A test last year and was fixed immediately.
The company's chairman said there was NO evidence of any ongoing air pollution.
The furniture company could face up to 175-thousand dollars in fines for exceeding air pollution standards.

The bones -- protected in plaster casts -- hitched a ride here with the Virginia National Guard.
The dinosaur skeletons were uncovered at an excavation in Wyoming this summer.
They'll be the first dinosaur skeletons on display in the state.
