A federal judge has put an end to Virginia's ban on late-term abortions, for now.
Today U-S District Judge Robert Payne declared the so-called "partial-birth" abortion ban unconstitutional, and issued a permanent injunction barring enforcement of it.
State Attorney General Mark Earley says he's disappointed by the decision, and will appeal to the federal appeals court.
The law, making certain late-term abortions illegal, had been in effect more than a year in Virginia.

In fact, none of the city's twelve elementary schools passed 5th grade history tests.. even though scores improved an average of 11 percent.
At the high school level, scores in World History after 1000 A.D. dropped a whopping 75 percent.. officials blame that on the fact that NO advanced placement students took that test this year.
And in math, scores, again, on average went up.. but NO school reached the 70 percent mark for passing.
Still, educators remain optimistic.

A New York City man has been charged with murder in Lynchburg.

24- year- old Norman Douglas White is accused of gunning down 26- year- old Morris Anthony Sunday night.
Police say White burst in on Anthony, as he sat in this home on Stuart Street and shot him several times.
They say the shooting stemmed from a dispute over drugs and money.
White was already in custody in Culpeper County on forgery charges.
He's also wanted in New York and New Jersey for drug violations.
He's being held without bond.

Darryl Lamont Fleming was convicted of capital murder for the stabbing death of 16- year- old Corey Pennix last August.
Fleming had claimed he acted in self defense when he killed Pennix, then stole cocaine from his pockets.
A Lynchburg jury opted "not" to give Fleming the death penalty, but did recommend a life term in prison for the murder and 25 years for the robbery.
A circuit court judge upheld that sentence today.

The 79-year-old founder of the Congress of Racial Equality died last week.
Farmer was noted for organizing non-violent protests, including the freedom rides to desegregate public transportation in the 60's.
