The day after Christmas turned violent at a Franklin county home.
Investigators say 26- year old Cletis Roberts, Junior of Bath County was shot in the torso after breaking into a house where his estranged wife, Katherine, was staying.
It happened on Hopkins Road, around two A-M yesterday.
The homeowner, 38- year old Arthur Simpson has been charged with firing the fatal shot.
Katherine Roberts' father has also been charged in connection with the crime.
Harold Nelson is accused of breaking into the house with his son-in-law and is also charged with the malicious wounding of his daughter.

Police are questioning the two following a shooting at a New York City nightclub where three people were shot and wounded.
Police say the pair were at the club when gunfire erupted early this morning.
They're being questioned as witnesses.

Local governments say they should get a piece of the state's three-point-four billion dollar budget surplus.
They say not enough attention is being paid to public education.
Recently, a legislative committee endorsed a proposal to increase school funding that would have cost the state an estimated one-point-two billion dollars.
Many localities believe that the funding is money the state should be spending anyway.
Virginia rates 43-rd in the country in state contributions to public education and last in the Southeast.

The crew of space shuttle Discovery is packing up its tools and preparing for the trip home to earth, after an eight-day mission of repairs to the Hubble Space Telescope.
Discovery is scheduled to land at Kennedy Space Center this afternoon.
The shuttle managers want to bring the orbiter down no later than Wednesday to avoid any potential Y2K computer problems.

For some stores the post Christmas frenzy is lucrative and offsets sometimes disappointing sales before the holidays.

And, a national survey finds nearly half of Americans return between one and ten holiday gifts each year.

Two endangered penguin chicks finally got up the nerve to pop their heads out in New York.

The penguins are a rare breed called Peruvian penguins. This is the first time these chicks have made a public appearance at the Aquarium of Niagara....even though they were born a month ago. Aquarium officials say baby penguins are covered in brown fluff and don't develop their tuxedos until they get older.
The aquarium has a total of 16 endangered penguins.
