The federal Nuclear Regulatory Commission could begin preparations as early as today for licensing the $6.5 billion plant.
"It's absolutely about time," said Ted Feigenbaum, a senior official at New Hampshire Yankee, the company that operates Seabrook. "It just shows that if you wait long enough, justice is forthcoming."
The U.S. Court of Appeals, in a unanimous decision Wednesday, refused to place a stay on issuance of a license for the plant.
Situated on the New Hampshire coast about two miles north of the Massachusetts line, the Seabrook plant can generate enough electricity to power 1 million homes.
Opponents of the plant said they will appeal.
