HAZELWOOD FILES INTENT TO APPEAL

The attorney for Joseph Hazelwood has filed notice that the former Exxon Valdez skipper will appeal his March 22 conviction on one count of negligent discharge of oil.

Dick Madson, a defense attorney based in Fairbanks, said the appeal will argue that Hazelwood was immune from prosecution because of federal and state laws that protect ship captains from prosecution if they immediately report a spill.

Hazelwood was ordered to pay $50,000 restitution and to perform 1,000 hours of community service cleaning the waterway.
