GROUP FILES SUIT TO STOP LANDFILL

A group of Amelia County residents has filed a lawsuit that seeks to block a proposed commercial landfill in the rural county.

The suit filed Friday in Amelia County Circuit Court attempts to invalidate a contract between the county and a landfill company and to void amendments to the county zoning ordinance that were adopted by the Board of Supervisors in May to allow the landfill.

The plaintiffs include 36 people, a church and an organization opposed the landfill that is planned by Chambers Waste Systems of Virginia Inc. The defendants are the county and Chambers.

The suit contends that the contract reached in January between the county and Chambers is illegal because it contains agreements that limit the authority of the supervisors to impose taxes and to zone or condemn land in the future.

The suit also contends that host fees promised the county in the contract are illegal because they are not among revenue-raising powers granted to counties by the General Assembly.

Norman Auldridge, administrator for Amelia County, said he could not comment on the specific allegations in the suit until he had seen it.

The board has scheduled a hearing for July 11 on Chambers' rezoning request for the landfill site.
