SCOTT RESIDENTS SUE AIR POLLUTION BOARD

Six Scott County residents and an environmental group have followed through on a promise to sue the state Air Pollution Control Board.

In a rare challenge of the board, the residents on Tuesday asked the Scott County Circuit Court to overturn the air agency's dismissal of their appeal of a permit for a Louisiana-Pacific waferboard plant.

Waferboard is a plywood-shaped building material that is made by gluing wood chips in a heated press. Louisiana-Pacific wants to increase waferboard production and to use a new kind of glue at its Dungannon plant, and last October was granted a conditional permit by the air board.

The Scott residents appealed the decision to ensure they would have a say in how the company complies with the permit's conditions. The board dismissed the appeal on June 8, saying it was incomplete.

Despite killing the appeal, state officials have said they do not intend to shut out residents from decisions on the permit.

The residents, however, believe they need their appeal reinstated in order to be guaranteed a say in further action on the permit.
