HAYMARKET ELECTION CHALLENGE HEARING SET

Aug. 14 has been set for a three-judge panel to hear a suit challenging the results of Haymarket's mayoral election, which returned Terri Freeborn to office in this Prince William County town despite her withdrawal from the race.

Her challenger, Councilman Richard Bird, lost by four votes in the May 1 election and filed the suit May 30.

In the suit, Bird alleges Freeborn gave up her chances for mayor when she announced her withdrawal weeks before the election. Bird claimed the vote would have been different had she taken her name off the ballot or properly informed voters she did not intend to run.

Just before the election, Freeborn said she would serve if re-elected.

Freeborn's attorney, John Foote, has filed a motion to dismiss the suit, saying there is "no legal cause or basis upon which to set aside her re-election."
