POLICE FORCE EXCESSIVE, BUENA VISTA MAN SAYS

A Buena Vista man who was arrested by Lexington police officers July 8 has filed a formal complaint charging they used excessive violence against him.

Troy Carter filed the complaint with Police Chief Bruce Beard, who is conducting an investigation. Beard said the inquiry may take a month.

Meanwhile, the officers - Sgt. E.W. Straub, Mark Ramos and Fred Smith - will continue their regular duties, Beard said.

During the arrest at the Palms Restaurant, Carter was hit on the head with a police nightstick causing a cut that required 10 stitches.

Beard said his officers received minor bruises during the altercation. One of them sprained his ankle, the chief said.

Carter was charged with assault and battery against a police officer, threatening bodily harm, destruction of property, resisting arrest and obstructing justice.

The officers were called to the restaurant to question another man who was acting abusively toward customers and the restaurant's owners.

When police arrived, Beard said Carter told them to leave the man alone because he wasn't doing anything wrong. Then, Carter struck one of the officers, Beard said, and a struggle took place.

Carter was arrested and taken to Stonewall Jackson Hospital in Lexington for treatment. He is free from jail on bond.

Beard would not comment on what disciplinary actions he would take against the officers if he found they used excessive force in arresting Carter.
