DAMAGES AGAINST AIRLINES LIMITED

A federal appeals court ruled Friday that airlines cannot be sued for punitive damages in cases involving international travel. The ruling came in two cases involving Pan Am, including the bombing of Flight 103 over Scotland.

A three-judge panel of the 2nd U.S. Circuit Court of Appeals said the Warsaw Convention on international air travel restricts lawsuits to compensatory damages.

The 1929 treaty, modified by the Montreal Agreement of 1966, limits compensatory damages to a maximum of $75,000 unless "willful misconduct" can be proved.
