MIGRANT WORKERS WIN PAY RULING ON APPEAL

Migrant farm workers who contended they were underpaid apple growers will be allowed to pursue their claim as a result of a federal appeals court ruling Thursday.

In a 2-1 decision, the court said U.S. District Judge James Turk erred when he ruled that the Department of Labor had approved wages paid to apple pickers in 1986.

The appeals court sent the case back to Turk. The class-action lawsuit was brought by the Farmworker Rights Organization and several individual workers.

The apple pickers, who were paid $4.72 per hour in Virginia and $4.49 per hour in West Virginia, claimed they were entitled to more than $6.
