COURT SAYS WARRANT NOT NEEDED FOR TESTS

Police do not have to obtain a search warrant before requiring a suspected drunken driver to take a Breathalyzer test, a federal appeals court ruled Wednesday.

A three-judge panel of the 4th U.S. Circuit Court of Appeals rejected two drivers' claims that conducting the test without a warrant was unconstitutional.

The appeals panel said Breathalyzer tests are less intrusive than blood tests, which already have been upheld by the U.S. Supreme Court in drunken-driving cases.
