FAIRFAX POLICE BRUTALITY SUIT DROPPED

A federal judge dismissed a police brutality suit against the Fairfax County Board of Supervisors and the police chief in the 1989 beating of a Washington, D.C., man.

U.S. District Judge Claude M. Hilton concluded Friday that neither the board nor the police chief contributed to or condoned the April 1989 beating of Victor M. Cruz by a Fairfax police sergeant.

Hilton said Cruz, 33, a native of El Salvador, presented "no evidence of an unconstitutional custom or practice" by Fairfax police.

Cruz charged in a federal lawsuit in September that he suffered permanent brain damage in 1989 when police handcuffed and clubbed him.
