ICC RAILROAD LEASE, SALE DECISION UPHELD

A federal appeals court Tuesday upheld an Interstate Commerce Commission decision approving the sale and lease of rail lines and equipment in Georgia by one railroad to another.

A three-judge panel of the 6th U.S. Circuit Court of Appeals unanimously upheld the ICC's decision approving CSX Transportation Inc.'s sale and lease of 224 miles of track to Wilmington Terminal Railroad Inc., of Wilmington, N.C. The lines involved run between Savannah and Rhine, Ga., and between Vidalia and Macon, Ga. The Railway Labor Executives' Association and the United Transportation Union had challenged the deal because it didn't require the buyer to negotiate with and hire the CSX employees who worked on those lines.
