The suit, filed Wednesday in U.S. District Court, asks a judge to bar the advertising.
Mark Gutsche, a spokesman for Nabisco Brands, a subsidiary of RJR Nabisco Inc., said Keebler's claim that Chips Deluxe has 25 percent more chips than Chips Ahoy! is flawed.
"That claim is false and illegal under state and federal law. Their cookie is bigger, so there's more chocolate in it. But ounce for ounce, it's virtually the same," Gutsche said.
