JUDGE: PROSECUTOR MUST DEFEND LICENSE

A Circuit Court judge on Thursday said Commonwealth's Attorney Joseph D. Morrissey must defend his license to practice law in light of his fight with a defense lawyer last month.

The ruling came as Morrissey sat in an isolation cell in City Jail serving a five-day sentence for contempt of court.

Circuit Judge Robert L. Harris Sr. told Morrissey he must show why his license to practice law should not be revoked or suspended. The order stemmed from an ethics complaint filed last month by Robert S. Reynolds, who has a history of filing suits against lawyers.

Three circuit judges from outside Richmond will conduct a hearing March 3 on Reynolds' allegation that Morrissey violated legal ethics.

Reynolds claimed the brawl with criminal defense attorney David P. Baugh "caused a mistrial and hindered the proper and adequate administration of justice."
