WOMAN SUING 2 DOCTORS AND HOSPITAL FOR $2 MILLION

A Pulaski County woman has sued two Blacksburg doctors and Montgomery Regional Hospital for $2 million, claiming the doctors performed a hysterectomy on her without her full consent.

The malpractice suit, filed Friday in Montgomery County Circuit Court by Radford lawyer Jimmy Turk, says Diane C. Whited received the hysterectomy in November 1989 after being admitted to the hospital for abdominal surgery.

The suit names Dr. David L. Meincke, Dr. William A. Isenhour and the hospital as defendants.

The suit says the hysterectomy was unnecessary and that it was performed even though Whited had told the doctors she did not want a hysterectomy.

Whited, who works at a Radford real estate firm, was told "that the need for a hysterectomy was practically nonexistent, and it would most certainly not be necessary nor performed" at that date, the suit says.

Turk said Friday afternoon that Whited, who is in her early 30s, had signed a consent form that said a hysterectomy was a possibility, but she also told the doctors she didn't want a hysterectomy.

Turk said Whited was led to believe that signing the form was standard procedure and that a hysterectomy would not be performed.

Turk said Whited was "absolutely devastated" upon learning the hysterectomy was performed. And, he said, she still has the stomach pain she originally went to have treated.
