COURT ALLOWS FORCED RETURN OF HAITIANS
The Supreme Court cleared the way Friday night for the Bush administration to repatriate 9,000 Haitian refugees to their homeland even while an appeals court decides the legality of the policy.
The high court granted the Justice Department's motion to stay a Miami federal court's injunction against the forcible return of refugees being held at the U.S. Navy base at Guantanamo Bay, Cuba.
The issue still is being argued before the 11th Circuit Circuit Court of Appeals in Atlanta, said a senior Justice Department official.
"As a practical matter, it means the government is free to begin the forced return of Haitians until the 11th Circuit's decision," agreed Ira Kurzban, who represents the Haitian Refugee Center.
Earlier Friday, the 11th Circuit court erroneously announced it had ruled in favor of the government. The court later withdrew the order, saying it was a clerical error.
