RADFORD JURY ISSUES RAPE INDICTMENTS

Two indictments for rape - including one that allegedly occurred in a Radford University dormitory - were among the 31 indictments issued Monday by a Radford grand jury.

The first rape charge involved two university students, while the second case involved a 13-year-old victim, according to court records.

Dereck Jerome Carter, 21, a junior at the university, was arrested by campus police last fall and charged with attacking a 19-year-old student in her room in Moffett Hall Sept. 22 at about 2 a.m.

Police said at the time of the arrest that there had been no forced entry into the room and that Carter and the woman had known each other but had not dated.

Carter, who is from Chatham and worked as a student assistant in the Jefferson residence hall, was suspended without pay after his arrest. Toby Phillips, director of campus police, said Monday that Carter is on interim suspension from the university.

The grand jury also indicted Elmer Louis Hayton Jr., 21, of Dublin on a charge of raping a 13-year-old girl on Sept. 20.

Detective R.T. Jones of the Radford Police Department said that, because the matter involved a juvenile, he could provide no further details on the case without consulting Commonwealth's Attorney Randal Duncan. Jones said Duncan is out of town until Thursday.
