TEACHER MUST REPAY SALARY, JUDGE SAYS
A Dickenson County judge ordered a teacher to repay the money she earned as a high school math instructor during the 1991-92 school year, saying the School Board violated state law when it hired her.Circuit Judge Donald A. McGlothlin Jr. said Thursday it was illegal for the School Board to hire Brenda Elswick to teach at Clintwood High School because her father was on the board.
"This is admittedly a harsh remedy, but one crafted by the General Assembly to ensure against violations of this act and to promote citizens' confidence in the integrity of the operation of public schools," McGlothlin wrote in a nine-page opinion.
The judge's ruling came more than a year after J.B. Crabtree filed a lawsuit against the School Board, Superintendent Gerald Triplett and Elswick. In his suit, Crabtree alleged he was not hired for the math teacher's job because of nepotism. - Associated Press
