Food Lion sues food workers unionSALISBURY, N.C. - Food Lion has filed a lawsuit against the United Food & Commercial Workers International Union, charging that the organization initiated a corporate campaign against the Salisbury-based supermarket chain.
The lawsuit charges abuse of process and seeks actual and punitive damages but no amount has been specified, according to court records.
The suit was filed in the Greenville, S.C., Circuit Court after Food Lion's directors met in Salisbury for nearly 10 hours.
The lawsuit comes more than three months after ABC's "PrimeTime Live" broadcast a segment charging Food Lion workers with repackaging out-of-date meat and maintaining unsanitary conditions. After the show aired, Food Lion officials said the allegations were false and that the UFCW was to blame.
Nicholas W. Clark, a UFCW attorney, said the case is without merit.
"It's part of the company's overall strategy to intimidate the employees or anybody who supports them with a union," Clark said from his Washington office.
"They are obviously forum-shopping by filing in South Carolina," Clark said. "They are looking for what may be anti-union sentiments in a particular area in order to win a case." - Associated Press

It is the second wave of closings since the company announced in August that it had uncovered evidence of a management-led fraud and embezzlement scheme and filed for bankruptcy court protection.
More closings are likely, the company said.
Last September, 55 unprofitable stores were closed. After the latest closings, the company will operate 224 stores in 25 states, including one in Roanoke.
